TERMS AND CONDITIONS OF AWCC EMAIL TO SMS SERVICE

Procedure and Eligibility to participate:

• Users must be at least 18 years of age or older.

• The service is valid only in Afghanistan.

• Subscription to Gmail on SMS is purely voluntary. The service is available via Short Code 282.

• The User hereby understands and gives his/ her irrevocable consent for personal information relating to the subscriber to be exchanged with or published and/or communicated to/in any media that it may deem fit, and or their vendors may, at its sole discretion choose to publish or disclose the name(s), phone number(s) and/or photographs of Users, if required, and specifically, of winners for the purpose of media coverage and alike activities.

• Users must have a Google Account in order to use the Gmail on SMS Service.

• To protect the User’s Google Account, the User should keep his/her password confidential. The User is responsible for the activity that happens on or via the User’s Google Account.

• Organizer will collect a limited amount of account information from the User’s Gmail Account and store and maintain the User’s information on secure servers.

• The account information (Gmail user name and password), of the User will have to be provided to Organizer by the User so that services can be provided by Organizer to the User.

• When the User provides his/her Gmail user name and password to login via Gmail on SMS, the User’s critical information (for example, the User’s password), will be maintained by the Organizer or the AWCC platform in an encrypted form only.

• The contents of the User’s Gmail account are stored and maintained on Gmail servers only in order to provide the service. Organizer or AWCC platform will only pull the content at regular intervals and push to end subscribers via SMS.

• Organizer will never sell, rent or share User’s personal information, including the Subscriber’s Gmail address or email content, with any third parties for marketing purposes.

• Organizer will log the service and user related information for internal purposes. For example, this information helps us determine how well our service is doing so we can continually improve the quality of Service. The log information is also important for security, audit, quality improvement, and other internal purposes

• As a standard email protocol, when user sends an email through this product, Organizer or AWCC system will include his/her email address and user name in the header of the email. Organizer or AWCC platform will not disclose user’s personal information to third parties.

• All the terms and conditions of Gmail’s privacy policy are also applicable to the Gmail on SMS product.

• Organizer or AWCC Platform will not be responsible if the email ID / password or both are leaked or misused by any third person/entity.

• User can unsubscribe from the Gmail on SMS Service any time. After unsubscribing from the service, the User will not receive any alerts and all the Users information on our server(s) will be deleted.

• Organizer may modify these terms or any additional terms that apply to the Service. Subscriber should review the terms regularly. Organizer will post notice of modifications to these terms of service on this page. If User does not agree to the terms of service, User should discontinue his/her use of the Service.

• Organizer or AWCC’s Platform uses commercially reasonable physical, managerial, and technical safeguards to preserve the integrity and security of User’s personal information. Organizer cannot, however, ensure or warrant the security of any information user transmit to platform and do so at his/her own risk. Please note that this is not a guarantee that such information may not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards.

• If User cannot or will not comply with these terms of service, then the User should not sign up for the Gmail on SMS service.

Unconditional Approval/Acceptance:

• The User is aware that SMS sent by the User may not be received by Organizer instantly due to various factors outside the control of the Organizer such as Network failure, system failure, etc.

• The time at which the User sent from his handset will not be considered even if it is earlier. (Example – User sent answer at 2 pm but it was received by Organizer only at 3 pm. Organizer will consider the time as 3 pm only).

• The User undertakes not to dispute/challenge the delay caused in receiving the SMS/Emails by Organizer system due to network failure, system failure, etc., which are beyond the control of Organizer or Operator.
